Purpose and Scope of the Terms of Use

The “Terms of Use” document serves as a legally binding agreement between Cheetah Net and you, the user of our fiber internet services. By accessing and using our services, you agree to abide by the terms and conditions outlined in this document. It is important to read and understand these terms as they govern your relationship with Cheetah Net.

The primary purposes of these Terms of Use are as follows:

  1. Establishing Rights and Responsibilities: These terms define the rights and responsibilities of both Cheetah Net and our users. They outline what you can expect from our services and what we expect from you in return.

  2. Protecting User Interests: These terms include provisions to protect your interests, such as privacy rights and guarantees of service quality.

  3. Maintaining a Safe and Fair Environment: By setting clear guidelines for user conduct, these terms help ensure a safe, secure, and fair online environment for all users.

  4. Clarifying Dispute Resolution: The terms also establish a framework for resolving disputes, should they arise, to ensure fair and efficient resolution.

  5. Informing Users: These terms aim to provide transparency regarding our services, billing practices, and other important information.

The scope of these Terms of Use covers your use of Cheetah Net’s fiber internet services, whether you are an individual, household, or business customer. It is essential to review these terms carefully to understand your rights and obligations while using our services.

Please note that these terms may be updated from time to time to reflect changes in our services or legal requirements. Therefore, it is advisable to periodically revisit this document to stay informed about any modifications that may affect your use of Cheetah Net’s fiber internet services.

By proceeding to use our services, you acknowledge that you have read, understood, and agreed to the terms and conditions set forth in this document. If you do not agree with any part of these terms, please refrain from using Cheetah Net’s fiber internet services.

II. Acceptance of Terms

A. User’s Acceptance of the Terms and Conditions

By accessing or using Cheetah Net’s fiber internet services, you, as the user, expressly acknowledge and agree to be bound by the terms and conditions outlined in this “Terms of Use” document. Your use of our services constitutes your acceptance of these terms in their entirety.

It is important to understand that these terms represent a legally binding agreement between you and Cheetah Net. Therefore, before using our services, we strongly recommend that you read this document carefully and ensure that you fully comprehend its implications.

Your acceptance of these terms implies your commitment to complying with all the rules, guidelines, and obligations set forth herein. Failure to adhere to these terms may result in consequences outlined elsewhere in this document, including the suspension or termination of your access to Cheetah Net’s fiber internet services.

B. Users’ Legal Capacity to Enter into This Agreement

By agreeing to these terms, you also represent and warrant that you have the legal capacity to enter into this agreement. This means that you:

  1. Are of Legal Age: If you are an individual user, you confirm that you are of the legal age required in Uganda to enter into contracts. If you are not of legal age, you must obtain parental or guardian consent to use our services.

  2. Have Authority: If you are accessing our services on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these terms. In such cases, “you” and “your” in this document refer to the business or entity you represent.

  3. Are Not Prohibited: You further certify that you are not prohibited by any applicable laws or regulations from using Cheetah Net’s fiber internet services. If any legal restrictions or sanctions prevent you from using our services, you are not permitted to access or use them.

It is your responsibility to ensure that you meet these legal capacity requirements. If you do not meet these criteria or if you disagree with any aspect of these terms, you should refrain from accessing or using Cheetah Net’s fiber internet services.

We reserve the right to verify the accuracy of the information you provide regarding your legal capacity to enter into this agreement. If we determine that you do not meet the necessary legal requirements, we may suspend or terminate your access to our services without further notice.

By using Cheetah Net’s fiber internet services, you affirm that you have read, understood, and accepted the terms and conditions outlined in this “Terms of Use” document and that you possess the legal capacity to enter into this binding agreement. Failure to meet these requirements may result in the termination of your access to our services and may subject you to legal consequences.

III. Access to Services

A. Eligibility Criteria for Accessing Cheetah Net Fiber Internet

To access and use Cheetah Net’s fiber internet services, users must meet specific eligibility criteria. These criteria are designed to ensure that our services are used responsibly and efficiently. The eligibility criteria may include, but are not limited to:

  1. Geographic Location: Users must be located within areas covered by Cheetah Net’s fiber internet network. Coverage areas are determined by our service infrastructure, and eligibility is subject to geographic limitations.

  2. Legal Capacity: As mentioned in the “Acceptance of Terms” section (Section II), users must have the legal capacity to enter into this agreement. This includes being of the appropriate legal age and not being subject to any legal restrictions that would prevent the use of our services.

  3. Payment Obligations: Users must meet their payment obligations as outlined in the billing and payment terms (Section VII). Failure to do so may affect eligibility for continued use of our services.

  4. Compliance with User Conduct: Users are required to adhere to the user conduct guidelines (Section V) to maintain eligibility for our services.

It is essential to note that eligibility criteria may evolve based on changes in our services, technology, or legal requirements. Cheetah Net reserves the right to modify eligibility criteria and will notify users of any such changes.

B. Registration and Account Creation

To access certain features of Cheetah Net’s fiber internet services, users may be required to register an account. Account registration may involve providing personal or business information, creating a username and password, and agreeing to our privacy policy and these terms of use.

Users are responsible for maintaining the confidentiality of their account credentials and for any activities that occur under their accounts. It is crucial to keep login information secure and to notify Cheetah Net promptly if there is any unauthorized use or breach of account security.

Cheetah Net reserves the right to suspend or terminate accounts that are associated with fraudulent or unauthorized activities or that violate these terms.

C. User Responsibilities and Obligations

When accessing and using Cheetah Net’s fiber internet services, users are expected to:

  1. Comply with Applicable Laws: Users must adhere to all applicable laws and regulations while using our services, including but not limited to laws related to internet usage, data protection, and intellectual property.

  2. Responsible Use: Users are responsible for using our services responsibly and in accordance with our user conduct guidelines (Section V). This includes refraining from activities that may harm the network or other users.

  3. Payment Obligations: Users must meet their payment obligations as outlined in the billing and payment terms (Section VII).

  4. Report Issues: Users should promptly report any technical issues, service disruptions, or security concerns to Cheetah Net’s customer support.

  5. Respect for Privacy: Users should respect the privacy of others and adhere to our privacy policy (Section VI).

Failure to meet these responsibilities and obligations may result in actions such as service suspension or termination, as outlined in this document.

By accessing and using Cheetah Net’s fiber internet services, users agree to meet the eligibility criteria, follow the registration and account creation process, and adhere to the responsibilities and obligations outlined in this section and throughout the “Terms of Use” document. Failure to comply with these requirements may result in consequences as defined herein.

IV. Service Description

A. Detailed Description of the Fiber Internet Services Offered

Cheetah Net provides high-speed fiber internet services that aim to deliver a seamless online experience for both residential and business users in Uganda. Our fiber internet services include:

  1. High-Speed Internet: Cheetah Net offers fast and reliable internet connectivity, allowing users to stream HD videos, engage in online gaming, conduct video conferencing, and download/upload large files with ease.

  2. Reliability: We pride ourselves on the reliability of our fiber network. Our infrastructure is designed to minimize downtime and service interruptions, providing you with a consistent online experience.

  3. Variety of Plans: We offer a range of internet plans to cater to different user needs, whether it’s for basic browsing, heavy streaming, or business operations. Users can choose from various speed options to match their requirements.

  4. 24/7 Customer Support: Cheetah Net provides around-the-clock customer support to address technical issues, service inquiries, and account-related questions promptly.

B. Service Coverage and Limitations

  1. Coverage Area: Cheetah Net’s fiber internet services are available in specific geographic areas of Uganda. Service coverage is determined by our network infrastructure, and we continuously work to expand our coverage to reach more users.

  2. Service Availability: While we strive to provide uninterrupted service, there may be instances of service disruption due to factors beyond our control, such as weather events, maintenance, or unforeseen technical issues. We make every effort to minimize such disruptions and provide timely updates to affected users.

  3. Bandwidth Usage: Users should be aware of their allocated bandwidth and data usage limits, if applicable, as outlined in their chosen service plan. Excessive bandwidth usage may affect service quality or result in additional charges.

  4. Network Congestion: During peak usage times, network congestion may occur, affecting internet speed and performance. Cheetah Net actively manages its network to optimize performance, but some variability in speed may be experienced.

C. Service Availability and Maintenance

  1. Scheduled Maintenance: Cheetah Net may conduct scheduled maintenance to enhance network performance or address technical issues. Whenever possible, users will be notified in advance of any planned maintenance that may temporarily affect their service.

  2. Emergency Maintenance: In the event of critical technical issues or security vulnerabilities, Cheetah Net may perform emergency maintenance without prior notice to ensure the safety and stability of the network.

  3. Service Outages: In the rare event of a service outage, Cheetah Net will work diligently to restore service as quickly as possible and will communicate updates to affected users via available channels.

  4. Technical Support: Users experiencing service disruptions or technical issues should contact Cheetah Net’s 24/7 customer support for assistance and updates on the resolution of their issues.

V. User Conduct

A. Appropriate Use of the Service

  1. Responsible Usage: Users are expected to use Cheetah Net’s fiber internet services responsibly and in a manner that respects the rights and needs of other users. This includes adhering to common-sense principles of internet etiquette and ethical use.

  2. Compliance with Laws: Users must comply with all applicable laws and regulations while using the service. This encompasses laws related to internet usage, data protection, intellectual property, and any other relevant legal requirements in Uganda.

  3. Respect for Network Resources: Users should use network resources reasonably and avoid engaging in activities that could result in excessive consumption of bandwidth or network congestion, which may negatively impact the service for others.

B. Prohibited Activities

  1. Illegal Activities: Users are strictly prohibited from using Cheetah Net’s fiber internet services for any illegal purposes, including but not limited to engaging in online fraud, hacking, distribution of malware, copyright infringement, or any activity that violates Ugandan law.

  2. Network Abuse: Users must refrain from any actions that constitute network abuse, such as attempts to compromise network security, interfere with network functionality, or engage in any form of unauthorized access to Cheetah Net’s systems or the systems of other users.

  3. Spam and Unsolicited Communications: Sending unsolicited emails, messages, or other forms of electronic communication (spam) is prohibited. Users should not engage in any activities that could be considered spamming or harassing other users.

  4. Inappropriate Content: Users must not use Cheetah Net’s services to access, transmit, or distribute inappropriate, offensive, or illegal content, including but not limited to hate speech, adult content, or materials that incite violence.

C. Consequences of Violating User Conduct Guidelines

  1. Investigation and Action: Cheetah Net reserves the right to investigate any suspected violations of these user conduct guidelines. If a violation is confirmed, appropriate action will be taken, which may include service suspension or termination.

  2. Legal Consequences: Engaging in illegal activities using Cheetah Net’s services may lead to legal consequences. Cheetah Net will cooperate fully with law enforcement authorities and provide necessary information for the investigation and prosecution of such activities.

  3. Notification: In cases of a suspected or confirmed violation, Cheetah Net may notify the affected user and provide an opportunity for the user to respond or rectify the situation, depending on the severity of the violation.

  4. Service Restoration: After taking action to address a violation, Cheetah Net may restore service to the affected user at its discretion, depending on the circumstances and the user’s compliance with the terms and conditions.

VI. Privacy and Data Protection

A. Privacy Policy and Data Collection Practices

  1. Privacy Policy: Cheetah Net is committed to protecting the privacy of its users. We maintain a comprehensive privacy policy that outlines our data collection, storage, and usage practices. By using our fiber internet services, you acknowledge that you have read, understood, and agreed to our privacy policy, which is an integral part of these terms.

  2. Data Collection: Cheetah Net may collect certain user information to provide and improve our services. This information may include personal and technical data, such as your name, contact information, device identifiers, and usage data. Our data collection practices are governed by applicable privacy laws and regulations.

  3. Consent: Where required by law, we will obtain your consent before collecting and processing your personal data. By providing us with your information, you consent to its collection and use in accordance with our privacy policy.

B. Handling of User Data and Information

  1. Data Use: Cheetah Net will use user data and information for the following purposes:

    • Provision and improvement of our fiber internet services.
    • Billing, account management, and customer support.
    • Communication of service-related updates, notifications, and promotional materials, where applicable and in accordance with applicable laws.
  2. Data Sharing: Cheetah Net will not sell or rent your personal data to third parties for their marketing purposes. We may share your information with trusted partners and service providers who assist us in delivering our services, subject to strict confidentiality and data protection agreements.

  3. Data Retention: We will retain user data for as long as necessary to fulfill the purposes for which it was collected, or as required by law. Users may request the deletion of their data, subject to legal and operational considerations.

C. Data Security Measures

  1. Data Security: Cheetah Net employs industry-standard security measures to protect user data from unauthorized access, disclosure, alteration, or destruction. These measures include encryption, firewalls, access controls, and regular security audits.

  2. Account Security: Users are responsible for maintaining the security of their account credentials. It is essential to use strong, unique passwords and to promptly report any unauthorized access or security breaches to Cheetah Net’s customer support.

  3. Data Breach Response: In the event of a data breach that may affect user data security, Cheetah Net will take immediate action to mitigate the breach, inform affected users as required by law, and cooperate with relevant authorities.

  4. Children’s Privacy: Cheetah Net does not knowingly collect data from children under the age of legal consent in Uganda without appropriate parental or guardian consent. If you believe that we have inadvertently collected data from a child, please contact us for its removal.

VII. Billing and Payments

A. Pricing, Fees, and Payment Terms

  1. Pricing: Cheetah Net offers various pricing plans for its fiber internet services, each with its associated costs and features. Users can select a plan that best suits their needs. Pricing details for each plan are available on our website and in our marketing materials.

  2. Fees: In addition to the base plan prices, users may be subject to certain fees, such as installation fees, equipment rental fees, or additional usage charges. These fees will be clearly communicated to users at the time of sign-up and in their account statements.

  3. Payment Terms: Users are required to make payments for their chosen service plan in accordance with the payment terms outlined during the sign-up process. Payment terms may include options for monthly, quarterly, or annual billing, depending on the selected plan.

B. Billing Cycles and Methods

  1. Billing Cycles: Cheetah Net operates on specified billing cycles. The billing cycle for each user is determined by their chosen payment frequency (e.g., monthly, quarterly). Users will receive invoices or statements detailing the charges for each billing cycle.

  2. Payment Methods: Cheetah Net accepts various payment methods, including credit cards, electronic funds transfer, and other forms of electronic payment. Users are responsible for ensuring that their payment information is accurate and up to date.

  3. Auto-Renewal: Some service plans may include auto-renewal options, which automatically renew the subscription at the end of each billing cycle. Users will be notified in advance of upcoming renewals, and they have the option to opt out of auto-renewal if they choose to do so.

C. Dispute Resolution for Billing Issues

  1. Billing Inquiries: If users have questions or concerns regarding their billing statements or charges, they should promptly contact Cheetah Net’s customer support. We are committed to addressing billing inquiries and resolving disputes in a timely manner.

  2. Dispute Resolution Process: Cheetah Net will investigate billing disputes in accordance with applicable laws and regulations. Users should provide relevant details and documentation related to the dispute to facilitate a resolution.

  3. Refunds: In cases where billing errors or overcharges are confirmed, Cheetah Net will issue refunds or credits to affected users. Refund processes and timelines will be communicated to users during the resolution process.

  4. Dispute Escalation: If a billing dispute cannot be resolved through regular customer support channels, users may have the option to escalate the matter through a formal dispute resolution process or mediation, as permitted by law.

IX. Intellectual Property

A. Ownership of Content and Materials

  1. Cheetah Net Content: All content and materials provided by Cheetah Net, including but not limited to text, graphics, logos, images, videos, software, and documentation, are the exclusive property of Cheetah Net and are protected by copyright and other intellectual property laws.

  2. Third-Party Content: Cheetah Net may also provide access to or integrate third-party content, such as software applications or services. Third-party content is subject to the respective intellectual property rights and terms of use of the third-party providers.

B. User-Generated Content

  1. License: When users submit or upload content, such as reviews, comments, or other user-generated materials, to Cheetah Net’s platforms (e.g., website, forums, social media), they grant Cheetah Net a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, distribute, and display that content for the purpose of providing and promoting our services. Users retain ownership of their original content.

  2. Responsibility: Users are solely responsible for the content they submit or share. Content must comply with applicable laws and regulations and must not infringe upon the rights of others, including intellectual property rights, privacy rights, and publicity rights.

C. Copyright and Trademark Information

  1. Copyright: Cheetah Net respects the intellectual property rights of others and expects users to do the same. If users believe that their copyrighted material has been used on our platforms without authorization, they should contact us with a notice of alleged copyright infringement. Cheetah Net will promptly investigate and take appropriate action in accordance with applicable laws.

  2. Trademarks: Cheetah Net’s name, logo, and other trademarks, service marks, and trade names are proprietary and may not be used without the prior written consent of Cheetah Net. Users are prohibited from using Cheetah Net’s trademarks in any manner that may cause confusion or imply endorsement.

  3. Third-Party Rights: Users should also respect the intellectual property rights of third parties when using Cheetah Net’s services. Any use or reproduction of third-party content or trademarks should comply with the rights and permissions granted by the respective owners.

X. Limitation of Liability

A. Disclaimer of Warranties

  1. As-Is Basis: Cheetah Net’s fiber internet services are provided “as-is” and “as available.” We make no warranties or representations, whether express or implied, regarding the quality, reliability, or availability of our services.

  2. No Guarantee of Uninterrupted Service: While we strive to offer uninterrupted and reliable service, we do not guarantee that our services will be free from interruptions, errors, or delays. Factors beyond our control, such as network congestion, technical issues, or external disruptions, may affect service quality.

  3. No Warranty of Fitness for a Particular Purpose: Cheetah Net does not warrant that its services will meet the specific requirements or expectations of individual users. Users acknowledge that they have chosen our services based on their own assessment of suitability.

B. Limitation of Liability for Damages

  1. Direct Damages: To the maximum extent permitted by applicable law, Cheetah Net, its affiliates, and their respective officers, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from or related to the use of our services.

  2. Exclusion of Liability: Cheetah Net disclaims all liability for damages arising from service disruptions, data loss, loss of profits, business interruption, or any other losses, even if we have been advised of the possibility of such damages.

  3. Statutory Rights: Nothing in these terms shall limit or exclude liability for death or personal injury resulting from negligence, fraud, or any liability that cannot be excluded or limited by applicable law.

C. Indemnification by the User

  1. User’s Responsibility: Users agree to indemnify, defend, and hold harmless Cheetah Net, its affiliates, and their respective officers, employees, and agents from any claims, losses, liabilities, damages, expenses, or costs (including attorney’s fees) arising from or related to:

    • Violation of these terms or any applicable laws or regulations.
    • User-generated content.
    • Use of Cheetah Net’s services.
    • Any third-party claims related to the user’s activities.
  2. Cooperation: Users agree to cooperate with Cheetah Net in the defense of any claims and to promptly notify us of any claims or threats of claims against them. We reserve the right to assume control of the defense and settlement of any such claims.

D. Governing Law and Jurisdiction

  1. Governing Law: These terms are governed by and construed in accordance with the laws of Uganda.

  2. Jurisdiction: Any disputes or claims arising from or related to these terms, Cheetah Net’s services, or user interactions with Cheetah Net shall be subject to the exclusive jurisdiction of the courts in Uganda.

E. Entire Agreement Clause

  1. Entire Agreement: This section represents the entire agreement between users and Cheetah Net concerning the limitation of liability. It supersedes any prior agreements, whether oral or written, related to this subject matter.

XI. Dispute Resolution

A. Process for Resolving Disputes or Conflicts

  1. Informal Resolution: In the event of any disputes, conflicts, or disagreements between users and Cheetah Net, both parties are encouraged to first seek an informal resolution by communicating directly with each other. Many issues can be resolved amicably through open and constructive dialogue.

  2. Formal Notice: If an informal resolution is not possible or does not result in a satisfactory resolution, either party may provide formal written notice to the other party, describing the nature of the dispute and the desired outcome.

  3. Mediation or Arbitration: In some cases, if informal negotiations and formal notices do not lead to resolution, the parties may agree to engage in mediation or arbitration. Mediation involves a neutral third party assisting in negotiations, while arbitration involves a third party rendering a binding decision. The specific process and rules for mediation or arbitration, if chosen, will be determined by mutual agreement or as required by applicable law.

  4. Legal Action: If mediation or arbitration does not lead to resolution, or if parties do not wish to pursue these methods, either party may choose to pursue legal action through the courts, as described in the “Governing Law and Jurisdiction” section (Section X.D) of these terms.

B. Jurisdiction and Governing Law

  1. Governing Law: These terms are governed by and construed in accordance with the laws of Uganda. Any disputes or claims arising from or related to these terms, Cheetah Net’s services, or user interactions with Cheetah Net shall be subject to Ugandan law.

  2. Jurisdiction: Any legal actions or proceedings arising from or related to these terms, Cheetah Net’s services, or user interactions with Cheetah Net shall be subject to the exclusive jurisdiction of the courts in Uganda.

  3. Alternative Dispute Resolution: Cheetah Net and users may agree to explore alternative dispute resolution methods, such as mediation or arbitration, before pursuing legal action. Such agreements shall be made in writing and signed by both parties.

XII. Changes to Terms of Use

A. Cheetah Net’s Right to Modify the Terms

  1. Reservation of Right: Cheetah Net reserves the right to modify, amend, or update these terms of use at its sole discretion. Any changes made to these terms will be effective immediately upon their posting on our website or through other means of notification, as described below.

  2. Reasons for Modification: Changes to the terms may be made for various reasons, including but not limited to legal compliance, service enhancements, or the need to address emerging issues or concerns.

B. Notification of Changes to Users

  1. Notification Methods: Cheetah Net will make reasonable efforts to notify users of changes to the terms. Notification may be done through one or more of the following methods:

    • Posting changes on our website or within the user account portal.
    • Sending email notifications to registered email addresses.
    • Sending in-app notifications or alerts.
    • Providing written notice through other means as deemed appropriate.
  2. Effective Date: Notification will include the effective date of the updated terms. Users are encouraged to review the updated terms and become familiar with the changes.

C. User’s Ability to Opt-Out in Certain Cases

  1. Opt-Out Right: In some cases, users may have the right to opt-out of specific changes to the terms. This right may be exercised by terminating their use of Cheetah Net’s services within a reasonable period, as specified in the notification.

  2. Continued Use as Acceptance: If users continue to use Cheetah Net’s services after the effective date of the updated terms, it will be considered an acceptance of the changes. Users who do not agree with the changes should refrain from using our services and may choose to terminate their accounts.

  3. No Retroactive Changes: Changes to the terms will not have a retroactive effect. They will apply only to future interactions and use of our services, unless otherwise specified in the updated terms.
